Children, Young People and Licensed Premises

The law about children and young people visiting licensed premises was changed with the making of the Licensing Act 2003.

The documents below provide guidance on the issues that need to be considered when applying for a new licence or a variation of an existing licence.

Since July 2007 it has been illegal to allow smoking within public buildings. A number of licensed premises have applied to vary the licence to include outdoor areas.

When making such an application there should be a further risk assessment of the impact that the change of use might have on children and young people, particularly if the area contains play equipment or is frequently used by families.

Applicants should consider:

  • the risks posed by alcohol left in discarded glasses/bottles
  • the risks posed by broken glass
  • appropriate securing of any heaters.
